Many privacy protection mechanisms that require LEAs to first obtain a warrant – or at least to inform the suspect of intrusive monitoring after the fact – do not apply to non-governmental entities that actually perform the work. While this is not necessarily illegal, such tactics clearly fall into a gray area of legal and ethical uncertainty.”
